Employer's liability for employee's damage

Employer liability is the legal liability of the employer for damage suffered by an employee during the performance of work. Under article 7:658 of the Civil Code, the employer must demonstrate having taken sufficient measures to prevent the damage. The burden of proof lies with the employer, meaning they must prove they were not negligent.

Based on employer liability, an employer can be held liable for a workplace accident.
