Obligation to first offer similar work within 26 weeks to a previously dismissed employee.
The reinstatement condition applies to dismissal for economic reasons: if the employer needs similar work performed within 26 weeks, this must first be offered to the previously dismissed employee. If the employer fails to do so, the dismissal can still be challenged.
