Uitzendovereenkomst
Temporary agency employment contract (uitzendovereenkomst)
An employment contract whereby a temporary employment agency makes an employee available to a hirer.
A temporary agency work contract is a special employment contract (Article 7:690 Dutch Civil Code (BW)) involving three parties: the temporary employment agency (the formal employer), the temporary agency worker (the employee) and the hirer (the company where the work is performed). The temporary agency worker works under the supervision of the hirer but receives wages from the temporary employment agency. There are three phases: A, B and C, each with increasing legal protection.
“In a temporary employment contract, the temporary employment agency is the formal employer.”
