Training Cost Recoupment Clause

A training cost recoupment clause requires an employee to repay all or part of training costs incurred if employment ends within a specified period.

A training cost recoupment clause is an agreement whereby an employee must repay training costs if they leave employment within a specified period.

As of August 1, 2022, stricter rules apply due to the European Directive on Transparent Working Conditions:

A clause that does not meet these requirements is void. Employers should review existing clauses against the new rules.

The training cost recoupment clause proved invalid because the training was legally mandatory and therefore the employer's responsibility.
