Statutory obligation of the employer to continue paying at least 70% of the salary for up to 104 weeks during illness.

Thecontinued wage payment obligationis the statutory obligation of an employer to continue paying an employee’s wages even when the employee is unable to work due to illness (Article 7:629 Dutch Civil Code (BW)).

After 104 weeks, the UWV takes over via the WIA scheme. Employers with large risk groups can insure themselves via a sickness insurance policy, and since 2020 the transition payment (transitievergoeding) upon dismissal after illness is compensated by the UWV.

During the first 52 weeks of illness, the continued wage payment obligation of 100% applied according to the collective labour agreement (CAO).
