Non-competition clause
A provision that restricts the employee from working for a competitor after the employment relationship.
A non-competition clause restricts an employee after the end of the employment from working for a competitor or starting their own competing business. Since 2015, a non-competition clause in a fixed-term employment contract is in principle no longer permitted, unless the employer provides written justification that the clause is necessary due to compelling business interests. The clause must have been agreed in writing with an adult employee.
