Additional compensation for seriously culpable employer conduct
Fair compensation is additional damages that the court can award on top of the transition payment when the employer has acted in a seriously culpable manner. The amount is determined by the judge and depends on the circumstances of the case. It concerns situations where the employer has behaved so improperly that the dismissal is not attributable to the employee.
